This terms and conditions outline the rules and regulations for the use of Clapup web services (the “Services”), including the services made available through this web site, or any applications accessible on any of our subdomains, or any other software or services offered by Clapup in connection with such services (the “Services”) that includes website, web-applications, applications, documentation portals, knowledgebases, blogs etc.
Acceptance of terms
By accessing this website, or any of our services, we assume you accept these terms and conditions. Do not continue to use Clapup if you do not agree to accept all of the terms and conditions stated on this page.
Terminologies
The following terminology applies to these terms and conditions, privacy statement and disclaimer notice and all gareements: “Client”, “You” and “Your” refers to you, the person log on to this website or any of our services and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company (Sycient Technologies LLP). “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the company’s stated services, in accordance with and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Scope of services
Clapup offers a comprehensive cloud-based Software as a Service (SaaS) platform designed to streamline collaboration across teams through efficient communication, document management, and content publishing tools. Our scope of service encompasses the following key areas:
Cloud-based collaboration platform
- SaaS platform: Clapup delivers a fully-hosted, cloud-based platform, ensuring that users can access the solution from any device, at any time, without the need for on-premise installations or hardware management.
- Subscription service: Our platform is available on a subscription basis, providing flexibility for organizations of all sizes to select the plan that best fits their needs.
- Self-service onboarding: Clapup offers an intuitive onboarding process, allowing customers to quickly set up and configure their accounts, users, and workspaces without requiring technical support.
Team inbox for unified communication
- Unified Messaging: Clapup provides a central inbox for managing communications across multiple channels, including email, social messages, and internal chats, ensuring teams can manage conversations in one place.
- Ticket management: The platform allows users to streamline customer support and internal communications through ticket assignment and tracking, ensuring timely responses and clear responsibility.
- Collaboration tools: Teams can collaborate seamlessly on communication threads by managing attachments, comments, and responses within a unified space, minimizing the risk of fragmented communication.
Document management system
- Centralized document storage: Clapup offers a robust document management system (DMS) that allows users to store, organize, and manage files in shared, personal, and team spaces within the cloud environment.
- Version control & collaboration: The DMS supports version control, co-editing, and commenting features, enabling real-time collaboration across teams without the need for multiple file versions.
- Metadata & search: The platform includes a powerful metadata modeling feature that allows users to categorize documents with custom fields, making it easier to find and manage content through enterprise-grade search capabilities.
Digital asset management
- Asset storage & publishing: Clapup enables users to store and manage digital assets such as images, videos, and files, and provides features for publishing assets to custom domains or external platforms.
- Internal & external sharing: Assets can be shared with internal teams or external partners, with permissions and access control to ensure secure sharing.
- In-built image & video tools: The platform comes with tools for editing images and hosting videos, simplifying the process of managing and distributing media content.
Web content management & publishing
- Content creation & management: Clapup simplifies the process of creating, managing, and publishing web content. Users can easily manage their websites or internal portals without the need for complex technical interventions.
- Content models & taxonomy: With powerful content modeling tools, users can create complex content types and taxonomies, allowing for structured content creation and organization.
- Collaboration & approval workflows: Teams can collaborate on content creation and publishing workflows, ensuring that all stakeholders are involved in the approval process before content goes live.
Security & Compliance
- Data security: Clapup ensures that all customer data is stored securely in the cloud, employing best practices for encryption, user authentication, and role-based access control.
- Compliance support: Our platform adheres to industry standards and regulatory requirements, ensuring data protection and privacy compliance across regions.
Support & maintenance
- Technical support: Clapup offers support through multiple channels, including email and live chat, providing assistance for any technical issues, account management, or feature inquiries.
- Regular updates: As a cloud-based service, Clapup ensures that the platform is continually updated with new features, security patches, and performance enhancements without requiring manual intervention by users.
- Service-Level agreement (SLA): Clapup provides guaranteed uptime and service performance based on the selected subscription plan, with defined response times for issue resolution.
Property rights
Unless otherwise stated, Clapup and/or its licensors (Sycient Technologies LLP) owns the intellectual property rights to the subscription service, including, without limitation, all modifications, improvements, enhancements, integrations, upgrades, derivative works, and feedback related thereto and all intellectual property rights therein (“Rights”), and any and all rights developed as part of the delivery and receipt of the subscription services. You may access this as cloud service or private instances or on-premise installations, for your own personal or commercial use subjected to restrictions set in these terms and conditions.
Ownership: All products, content, and materials provided by the Company are protected by copyright and intellectual property laws. You may not reproduce, distribute, or modify any part of our products or materials without our explicit written consent.
Pricing: Prices for our products are subject to change without notice. The Company reserves the right to modify or discontinue certain features or services at any time with a prior notice adequet for the migration of your data.
Payment: All payments are processed securely through a third-party payment processor. You agree to provide accurate and complete payment information and authorize us to charge your payment method for all purchases made through our Services.
Prohibited activities
Use, display, mirror, frame or utilize framing techniques to enclose the site or services, or any individual element or materials within the site or services, Clapup’s name, logo or other proprietary information, the content of any text or the layout and design of any page or form contained on a page, without Clapup’s express written consent.
Attempt to probe, scan, or test the vulnerability of any Clapup’s system or network or breach any security or authentication measures; attempt to probe, scan, or test the vulnerability of any Clapup’s system or network or breach any security or authentication measures.
Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Clapup or any of Clapup’s providers or any other third party (including another user) to protect the Site, Services or our customers.
Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of unsolicited messages. Impersonate or misrepresent client’s affiliation with any person or entity.
Using clapup account as a mean to develop or build products which perform substantially similar to the Services for the term of this agreement.
Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services or content used by Clapup.
Usage of our platform to store any pornographic or erotic content, child pornographic content or any form of such content.
Accountability and warranties
Ownership
We consider the user who created the host/master account as the sole owner of that account with any number of invited users, workspaces or locations attached.
You are solely responsible for all actions performed in the services with your account. Storing your credentials safe is your sole responsibility. If you feel that, your account is compromised or your password is stolen, immediately inform us, so that we can lock your account and take necessary steps to fix the issues.
Your Warranties
While using our service and products, i.e. while you are in an active subscription period, you represent and warrants to us that
- You have, and will always have, all rights, licenses, and consents required for your use of the Services.
- You will comply with all applicable laws, rules, and terms that outlined in this document. If you have any doubts in any of your use cases or usage, you can always contact us [email protected]
- You were not previously prohibited by us from entering into an agreement with us nor was your account and/or use of the Services previously blocked, suspended or terminated by us for any reason.
Acceptable usage policy
When you create an account with Clapup, you are accepting all the terms with us so.
- Don’t allow others to use your account, by means of sale, lease, assign, transfer, pledge, or any other activity that may be considered as sharing or conveying ownership in your account.
- Don’t copy or scrape our website or applications, and don’t replicate its functionality. Don’t try to use our data which is not intended to the original purpose for which it is made.
- Don’t use automated tools to submit queries or posts, and don’t mine personal information from our website.
- Don’t try to overload our servers and infrastructure by any means that can be potentially recognized as a Direct Denial of Service attack by our protection measures.
- To manage businesses that promotes illegal or harmful activities or substances or provide instructional information regarding the manufacture or purchase of illegal weapons or illegal substances.
Abusive Customers
We believe that our customers have every right to be heard, understood and respected. But we also believe that our staffs have every right to work in a safe environment, free from any abuse or harm caused by others.
Abusive or aggressive behavior includes language (whether verbal or written) that may cause our staff to feel threatened or abused and may include threats, personal verbal abuse, derogatory remarks and rudeness. Unacceptable behavior as described above may cause us to decide to, by our sole discretion:
- Termination of accounts.
- Take any actions that we feel appropriate based on the situation that includes, termination of contract and your access to our platform, permanent ban to access our system and services etc.
Services terms
Type of accounts
Clapup have two types of accounts. The terms and conditions outlined in this document are applicable to all type of accounts/users.
Host Accounts: Accounts which is registered and subscribed to our plans for managing workspaces. Such accounts can create and host workspaces. The Account owner will be the super admin of the workspace created.
Guest Accounts: Any users who are invited to collaborate on a workspace are guest accounts. even though they will have different roles like Admin, Editor etc, they can’t create a workspace. Such accounts don’t need to subscribe to any of our service.
Eligibility and Identification
During the process of new account registration, we may verify the identity using various third-party tools. As a part of this verification, we may request additional information. The Services are intended for use by users of at least eighteen (18) years old. If you register for our services, you hereby declare that you are eighteen (18) years old or older and undertake to monitor your account to ensure that no minor under that age has access to the Services.
Message Inbox
Our message inbox is primarily aimed at providing customer support, and team wide communication. Its is not intended for mass emailing or cold emailing. We had system in place to track the number of emails send from every workspace. If we found any malicious bahaviour, your email sending capability will be restricted and you will be asked to submit the reason in 7 days, failing will result in account termination.
Document management system and DAM
Our document management and digital asset management systems are intended for storing your files, documents, digital assets (Images & Videos) and any other relevant data. If we found that you are using this to store any copyrighted, illegal or child pornographic content, we will issue a notification to remove such content immediately, failure in responding to such notifications will lead to your account termination.
Copyrighted Materials: Storage or transmission of any text, graphics, images, software, music, audio, video, information or other material that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights are against our terms.
Child Pornography: Storage or transmission of any text, graphics, images, software, music, audio, video, information or other material that contains constitutes child pornography or child erotica are against our terms.
Vulgar and Obscene Materials: Storage or transmission of any text, graphics, images, software, music, audio, video, information or other material that contains is defamatory, obscene, vulgar or offensive are against our terms.
Hatred and Racism: Storage or transmission of any text, graphics, images, software, music, audio, video, information or other material that promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group is against our terms.
Automation:
Any attempt to use any automation in our platform will recieve an instant ban. If we found account that uses browser extension to automate anything inside the platform will get a IP wide ban.
Refund and cancellation
At Sycient, we strive to create quality software that you enjoy using for your business or professional life. You have a number of choices and we appreciate you giving us your business. Thank You. We have created this policy that details what we will do should we fail to meet your expectations.
Monthly Subscriptions. If at anytime during your first 7 days using our service you are dissatisfied, please contact us. We will do our best to address your issue, provide a work around or give a timeline for a solution that will meet your needs. If you are not satisfied, we will gladly offer you a FULL REFUND for your purchase, and remove you account without further questions asked.
Annual Subscriptions: Sycient or Clapup doesn’t force you into an annual subscription as a condition to use our services. We prefer to give you the flexibility to choose. In exchange for you signing up for an annual up-front commitment, we offer you a significant discount over the already-low monthly subscription cost. If at anytime during your first 15 days using our service you are dissatisfied, please contact us. We will do our best to address your issue, provide a work around or give a timeline for a solution that will meet your needs. If you are not satisfied, we will gladly offer you a FULL REFUND for your purchase, and downgrade your account to the free plan.
We want you to be happy with our service throughout your entire contract, not only the first 7 days (in case of monthly subscription) and the first 15 days (in case of annual subscription). So we go beyond that. If at anytime during your contract we remove, break or discontinue functionality that was available at the time you signed up for our services , we ask you to notify us immediately. If we fail to address the breakage of a functionality within any promised timelines , or if we are unable to provide a satisfactory work around for discontinued functionality, we will offer you a PRO-RATED REFUND for the reminder of your contract.
Auto-Renewal: For your convenience, your monthly and yearly subscriptions will auto-renew until you cancel the service. Every time before your subscription auto-renews, we will send a mail specifying the amount that will be charged to your credit card. Similarly, after each renewal we will send you a receipt via e-mail specifying the amount that has been deducted together with the next renewal date and the next renewal amount.Auto-Renewal. For your convenience, your monthly and yearly subscriptions will auto-renew until you cancel the service. Every time before your subscription auto-renews, we will send a mail specifying the amount that will be charged to your credit card. Similarly, after each renewal we will send you a receipt via e-mail specifying the amount that has been deducted together with the next renewal date and the next renewal amount.
We know that sometimes customers forget to cancel an account they no longer want until it is has already been charged. That’s why you can cancel your subscription even upto five business days after your renewal date (for monthly subscriptions) or fifteen days after your renewal date (for annual subscriptions), and be eligible for a FULL REFUND . However, we will NOT be able to entertain requests for refund, including any for PRO-RATED refunds, after the said periods.We know that sometimes customers forget to cancel an account they no longer want until it is has already been charged. That’s why you can cancel your subscription even upto five business days after your renewal date (for monthly subscriptions) or fifteen days after your renewal date (for annual subscriptions), and be eligible for a FULL REFUND . Exception to our Refund Policy
There will be strictly no refund (FULL OR PRO-RATED) in cases where your account is terminated or suspended or blocked by Sycient or Clapup for activities that are in violation of our Terms of Service including, but not limited to phishing, impersonation, fraud, and violation of any applicable laws.

Disclaimer
You agree that your use of our services is at your own risk. All services are provided on a subscription basis and are offered “as is” for commercial purposes, with standard support included as part of your subscription. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including without limitation implied warranties of merchantability, and fitness for a particular purpose. To the best of our knowledge, the services provided do not infringe upon the intellectual property rights or other rights of third parties. While we strive to maintain a bug-free experience and ensure maximum uptime, we do not guarantee that the services will be completely error-free. We take reasonable measures to ensure that the services and the server(s) are free from viruses or other harmful components, but we do not provide absolute guarantees in this regard. Some of the above limitations may not apply to you, depending on your jurisdiction.
